Ph.D.-student within insurance law, with a project regarding double insurance.
About the Ph.D. project:
A fundamental principle in non-life insurance is that the secured shall not have his loss covered more than one time. Still, he might have several insurance contracts which altogether provides larger coverage. Then the question is which companies he shall be compensated from and where the loss shall be settled at last. The Norwegian Insurance Contract Act section 6-3 states for such instances that the secured has a right to choose between the insurances that cover the same loss, until he has received the compensation he is entitled to. The loss shall then be settled proportionally between the insurers according to their liability.
The main question in the project is how one shall understand the criterion «the same loss». To understand this criterion, it is need for a closer look at the concept of insurable interest, and the relation between interest and loss.
