Can you train your AI on copyrighted works? Can AI-generated output be protected by copyright? Can AI-generated output itself infringe copyright? In this lecture Emeritus Professor Bernt Hugenholtz explores the main copyright issues raised by the use of copyrighted works in machine-learning systems.

This seminar addresses key copyright challenges arising from the use of copyrighted materials in machine learning and generative AI. It explores legal boundaries, examining whether training AI systems on copyrighted content constitutes infringement. The discussion will also highlight possibilities and limitations concerning copyright protection of AI-generated outputs. Additionally, the seminar considers circumstances under which AI-generated content itself might infringe existing copyrights, typically works the AI has trained on.

Bernt Hugenholtz is one of the foremost authorities on European copyright law. He is Emeritus Professor of Intellectual Property Law at the University of Amsterdam and Emeritus Professor II at the Faculty of Law, University of Bergen.
